A nine-state Cyclospora outbreak traced to shredded iceberg lettuce supplied by Taylor Farms de Mexico and served at Taco Bell restaurants had reached 1,947 confirmed illnesses and 98 hospitalizations as of July 24, according to FDA and CDC. The case counts span Illinois, Indiana, Kansas, Kentucky, Michigan, Ohio, Oklahoma, Pennsylvania, and West Virginia — and CDC's broader surveillance page logged 4,173 laboratory-confirmed domestically acquired cases across 41 states, plus more than 7,400 additional unconfirmed reports concentrated in Michigan and Ohio. Michigan alone has reported 8,176 cases and 160 hospitalizations against a baseline of roughly 50 per year.
No Kill Step Exists
For operators, equipment specifiers, and cold-chain managers, the technical core of this outbreak carries an uncomfortable message: there is currently no validated kill step for Cyclospora on ready-to-eat produce that a commercial kitchen can apply. Food safety attorney Bill Marler, managing partner of Marler Clark and a litigator in the food-safety space since the 1993 Jack in the Box E. coli outbreak, made that point his central argument at IAFP 2026 in New Orleans this week. A 2021 study in Foods found that rinsing removed at least 80 percent of two other parasites from raspberries but only 39 percent of Cyclospora — and no method eliminated it entirely. Chlorine, the backbone of commercial produce-wash systems, is explicitly described by FDA as ineffective against Cyclospora cayetanensis. Heat destroys the parasite but also destroys iceberg lettuce. The implication for any back-of-house prep-and-storage operation is stark: no post-receipt intervention a kitchen can perform on shredded iceberg lettuce closes this gap.
"Every process this industry validated was validated against bacteria," Marler said. "Cyclospora is not a bacterium, and the chemistry that kills E. coli does nothing to it — FDA says so in its own fact sheet. If you cannot make contaminated lettuce safe, then the entire answer is keeping it from being contaminated in the first place."
The Water and Traceability Problem
The parasite has a single reservoir: the human gut. Contamination reaches produce through irrigation water or field sanitation failures. Dr. Mark Moorman, until recently director of FDA's Office of Food Safety, noted this week that investigators have never definitively identified the contamination source in any Cyclospora outbreak across thirty years of investigation — and that no rule currently requires a farm to test its irrigation water or finished produce for the organism. Testing is voluntary.
The same Taylor Farms facility in Doctor Mora, Guanajuato, was linked to the 2013 Cyclospora outbreak in salad mix. An FDA and COFEPRIS environmental assessment conducted at that time recommended that the company determine whether Cyclospora was a reasonably likely hazard in that growing region and, if so, re-evaluate its wash step. No public document confirms that determination was ever completed.
Marler is calling for five regulatory and industry changes: switching pre-harvest agricultural water treatment from chlorine chemistry to microfiltration, ozone, or ultraviolet light; replacing generic E. coli testing of irrigation water with human-specific fecal markers; explicitly naming Cyclospora in the pre-harvest agricultural water rule and requiring importers to document protozoa-effective treatment; closing the field sanitation exemption that leaves small-crew operations without required handwashing stations; and restoring surveillance — Cyclospora was removed from CDC's FoodNet program last July, the Food Traceability Rule enabling 24-hour lot-level recall records cannot be enforced before July 2028, and the parasite is not tracked in CDC's national wastewater monitoring system.
For foodservice operators specifying cold-chain and storage equipment or reviewing ingredient sourcing, the outbreak underscores that pre-cut, ready-to-use leafy greens present a residual risk that no receiving inspection protocol or produce-wash step currently in commercial use can eliminate. The National Advisory Committee on Microbiological Criteria for Foods delivered FDA a full report on Cyclospora cayetanensis in produce in 2023, documenting resistance to common chemical treatments; that report has been at the agency for three years without triggering new requirements. Until upstream water treatment standards are redesigned around protozoa rather than bacteria alone, operators absorb the downstream liability — and their customers absorb the risk.
